Fee Simple vs Leased Fee Interest

feesimpleIn Texas, the Supreme Court has ruled on three separate occasions that all leases should be valued using market rate rents in determining the value of the real estate.  To do otherwise would be to value the leased-fee interest in the property rather than the fee simple interest as required by law.  Even though Property Tax Advocates pointed this out to the appraiser, he refused to accept the substantially lower market rates and also take into account the fact that the office building was only 55% occupied even though it was 100% leased.

diamondhillBased on the recommendation of his regional vice president, the owner of an Atlanta real estate development company called on Property Tax Advocates to determine whether to file a lawsuit appealing the value of a newly constructed tax credit property in Texas.  Another national property tax consulting firm presented the case to the board but the owner questioned the value reduction determined by the board from $12,630,393 to $11,900,000.
